Felon Charged for Firearm Possession; Witness Tells Police He Shot at Street Lights

AndrewHuttonA witness told Pine County deputies that Andrew Hutton was shooting a BB gun at street lights on Wednesday, December 6th.  Hutton, 27, denied the accusation, but admitted he bought the firearm.  He was charged Friday with possession of a firearm by a felon and now faces over a decade in prison.

According to the criminal complaint, a witness told deputies they saw Hutton shooting a “black BB-style handgun” at street lights in Pine City.

Deputies responded to the apartment where Hutton was staying.  When they arrived, he was not there, but they located a Crosman brand made Pro 77 Co2 powered BB style handgun, according to the complaint.

The complaint states, when Hutton returned to the apartment, he admitted to officers that he did purchase the gun and was aware that because of his criminal record he was not to possess a firearm, but did not believe that stipulation applied to BB guns.

Hutton told police he shot the gun 18 times but only at the ground and in the air with no BB’s.  He denies the witness account that he fired at street lights.

Hutton was arrested Thursday and charged Friday with one count of possession of a firearm by a felon.

Court records indicate Hutton was convicted of first degree criminal damage to property in 2007,  fourth degree assault of a peace officer in 2005, and domestic assault in 2003.

If convicted of the firearms charge, Hutton could serve 15 years in prison and/or pay a $30,000 fine.
